    We had a good follow up question from the webinar:

    QUESTION:

    My 401(k) owns a note secured by deed of trust (in California). The borrower stopped paying so my 401(k) foreclosed and a trustee sale of the property is scheduled in a couple of weeks. As is standard, the proceeds of the sale of the property will be applied to satisfy the balance due on the note.

    Can I personally bid on the property at the trustee sale?

    RESPONSE:

    Doing so is prohibited from a Solo 401k perspective (eg if your bid is accepted the proceeds will flow to your Solo 401k and thus result in a transaction between you and your Solo 401k). I presume that you are allowed to bid (eg there aren’t bias rules at the auction prohibiting your participation).
